TERRAVELA TERMS OF SERVICE

Welcome to Terravela.

These Terms of Service ("Terms") govern your access to and use of the Terravela mobile application, website, and related services (collectively, the "Services"). By creating an account, accessing, or using Terravela, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not use the Services.

1. Eligibility

You must be at least 13 years old to use Terravela.

By using the Services, you represent and warrant that:

  • You are at least 13 years of age.

  • You have the legal capacity to enter into these Terms.

  • You will comply with all applicable laws and regulations.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials.

You agree to:

  • Provide accurate information.

  • Keep your account information current.

  • Protect your login credentials.

  • Notify Terravela of unauthorized access to your account.

You are responsible for all activity that occurs under your account.

3. Terravela Services

Terravela provides travel tracking and exploration features, including:

  • Travel mileage tracking

  • Exploration progress tracking

  • City, state, and country discovery tracking

  • Badges and achievements

  • Leaderboards

  • Friend connections

  • Travel statistics

Terravela may add, modify, suspend, or remove features at any time.

4. Location Services

Certain features require access to your device's location.

By enabling location permissions, you acknowledge and agree that:

  • Terravela may collect and process location information.

  • GPS information may not always be accurate.

  • Travel calculations are estimates.

  • Exploration progress may contain inaccuracies.

  • Badges, achievements, rankings, and mileage calculations may occasionally contain errors.

Terravela does not guarantee the accuracy of location-based features.

5. Travel Tracking Disclaimer

Terravela is intended for entertainment, personal travel tracking, and exploration purposes.

Travel data may be affected by:

  • GPS signal limitations

  • Device settings

  • Network interruptions

  • Software updates

  • Operating system restrictions

  • Hardware limitations

Terravela is not responsible for inaccuracies in travel records, mileage totals, exploration progress, or rankings.

6. Badges, Achievements, and Leaderboards

Terravela may provide badges, achievements, rankings, and leaderboard positions.

These features:

  • Have no monetary value.

  • Are provided for entertainment purposes.

  • May be modified, reset, suspended, or removed at any time.

  • Do not create ownership rights.

Terravela reserves the right to adjust qualification requirements and ranking calculations at its sole discretion.

7. Friend Features

Terravela may allow users to connect with other users.

Users agree to:

  • Treat others respectfully.

  • Avoid harassment or abuse.

  • Respect the privacy of other users.

  • Avoid impersonating others.

Terravela is not responsible for user interactions or relationships formed through the Services.

8. Acceptable Use

You agree not to:

  • Violate any law or regulation.

  • Harass, threaten, or abuse others.

  • Impersonate another person or organization.

  • Attempt unauthorized access to accounts or systems.

  • Interfere with platform operations.

  • Upload malicious code.

  • Use automated tools to manipulate the Services.

  • Circumvent security measures.

9. GPS Spoofing and Cheating

Terravela relies on accurate travel data.

You may not:

  • Use GPS spoofing software.

  • Falsify location information.

  • Artificially generate mileage.

  • Manipulate badges, achievements, or rankings.

  • Exploit bugs or vulnerabilities.

Terravela may investigate suspected abuse and may:

  • Remove travel progress.

  • Revoke badges or achievements.

  • Reset statistics.

  • Suspend accounts.

  • Permanently terminate accounts.

Terravela has sole discretion in determining whether cheating has occurred.

10. Safety

Your safety is more important than any badge, achievement, ranking, or travel statistic.

You agree that you will not:

  • Use Terravela in a manner that distracts you while driving.

  • Operate a vehicle while interacting with the application.

  • Trespass on private property.

  • Enter restricted or unsafe areas.

  • Violate local laws while using the Services.

Terravela does not encourage unsafe behavior.

All travel decisions remain your sole responsibility.

11. User Content

Users may provide usernames, profile images, and other account-related content.

You retain ownership of content you submit.

By submitting content, you grant Terravela a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute such content solely for operating and improving the Services.

You represent that you have the necessary rights to any content you upload.

12. Intellectual Property

Terravela and its licensors own all rights, title, and interest in the Services, including:

  • Software

  • Branding

  • Logos

  • Badge artwork

  • Achievement systems

  • Designs

  • Graphics

  • Visual elements

  • Documentation

No ownership rights are transferred to users.

13. Copyright Complaints

If you believe content available through Terravela infringes your copyright, please contact:

Please include sufficient information to identify the allegedly infringing material and your ownership claim.

14. Third-Party Services

Terravela may utilize third-party providers for services such as:

  • Authentication

  • Hosting

  • Analytics

  • Mapping

  • Infrastructure

Terravela is not responsible for third-party services or their policies.

15. Account Suspension and Termination

Terravela may suspend or terminate accounts at any time if:

  • These Terms are violated.

  • Fraud is suspected.

  • Cheating is detected.

  • User activity threatens platform integrity or user safety.

Users may stop using the Services at any time.

Users may request account deletion through available account settings or by contacting Terravela.

16. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TERRAVELA DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

Terravela does not guarantee uninterrupted, error-free, secure, or accurate operation of the Services.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TERRAVELA SHALL NOT BE LIABLE FOR:

  • Lost travel data

  • Lost mileage

  • Lost badges

  • Lost achievements

  • Lost rankings

  • Service interruptions

  • Device issues

  • GPS inaccuracies

  • Indirect damages

  • Consequential damages

  • Incidental damages

18. Indemnification

You agree to defend, indemnify, and hold harmless Terravela, its affiliates, contractors, and representatives from claims, damages, liabilities, losses, and expenses arising from:

  • Your use of the Services.

  • Your violation of these Terms.

  • Your violation of any law or third-party rights.

19. Governing Law

These Terms shall be governed by the laws of the State of Texas, without regard to conflict-of-law principles.

20. Dispute Resolution

Before filing any legal claim, you agree to first contact Terravela and attempt to resolve the dispute informally.

Any dispute arising out of these Terms shall be resolved through binding arbitration in Texas, except where prohibited by applicable law.

You agree that claims will be brought only on an individual basis and not as part of a class action.

21. Force Majeure

Terravela shall not be liable for delays or failures caused by events beyond its reasonable control, including:

  • Natural disasters

  • Internet outages

  • Government actions

  • Labor disputes

  • Power failures

  • Cyberattacks

  • Telecommunications disruptions

22. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

23. Entire Agreement

These Terms and the Privacy Policy constitute the entire agreement between you and Terravela regarding the Services and supersede any prior agreements or understandings.

24. Changes to These Terms

Terravela may update these Terms from time to time.

Material changes may be communicated through the application, website, email, or other reasonable means.

Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
